Terms Of Service

1. PARTIES

This Membership Agreement ("Membership Agreement") has been arranged between OGSTASH ('ogstash.net') and the user ("Member"), regardless of how it is accessed, to become a member by completing the registration process on all websites, mobile applications, services and tools owned or managed by OGSTASH (collectively the "Platform") and to determine the terms and conditions for the Member to benefit from the following services offered by OGSTASH.

OGSTASH is operated by Jakub Miechowicz, a sole proprietor, with registered address at Pod Stawami 25, 26-026 Zaborze, Poland, NIP: 6572984779, REGON: 527347454, e-mail: contact@ogstash.net.

OGSTASH and the Member shall be referred to as "Parties" together in this Membership Agreement.

By approving this Membership Agreement, using the Platform and/or making transactions on the Platform, the Member accepts the conditions set out in the Membership Agreement.

2. DEFINITIONS

In the application and interpretation of the Membership Agreement, the terms written below refer to the written explanations opposite them.

3. SUBJECT OF THE CONTRACT

The subject of the Membership Agreement is to determine the Platform Services, the conditions for utilising the Platform Services and the rights and obligations of the Parties.

4. TERMS OF MEMBERSHIP AND PLATFORM SERVICE USAGE

4.1. Membership is completed by the person who wants to become a member from the relevant section of the Platform and by entering the necessary information by the person who wants to become a member, and then by the approval of the registration process by OGSTASH. Without completing the membership process, the title of Member or membership rights and authorisations defined in this Membership Agreement cannot be obtained.

4.2. The user who wants to become a member of the Platform must have completed the age of 18 (eighteen), meet the other conditions to be determined by OGSTASH and stated below and fulfil the necessary conditions in accordance with the provisions of the relevant legislation. In addition, persons who have been temporarily suspended from membership or banned from membership indefinitely by OGSTASH pursuant to this Membership Agreement cannot become a member again.

5. RIGHTS AND OBLIGATIONS OF THE PARTIES

5.1. For membership, the information specified on the membership registration page on the Platform must be entered correctly and completely and the Membership Agreement must be approved. The Member declares and undertakes that the personal and other information provided by the Member is correct before the law. OGSTASH shall not be liable and responsible for investigating the accuracy of the information and content transmitted to OGSTASH by the Member or uploaded, modified or provided by the Member through the Platform.

5.2. The Member may not give the password he/she set while registering to the Platform to other persons or organisations, and the Member's right to use the password in question belongs to himself/herself. The security and confidentiality of the e-mail address and the password used by the Member while registering to the Platform are the sole responsibility of the Member.

5.3. The Member accepts, declares and undertakes that he/she will comply with and not violate all the terms contained in the Membership Agreement, the rules specified in the relevant parts of the Platform and all applicable legislation provisions.

5.4. OGSTASH is not responsible for the authenticity, reliability, accuracy or lawfulness of any visual, written or other content on the Platform, except for the Products offered for sale by OGSTASH itself, and OGSTASH has no obligation to check such content or to investigate whether there is any illegal activity on the Platform.

5.5. The Member agrees that OGSTASH is in no way a party to the Sales Contracts to be concluded with the Sellers, except for the Sales Contracts in which OGSTASH is the Seller itself. The Sellers accept, declare and undertake that the Sellers are personally responsible in every sense within the scope of the applicable consumer legislation.

6. PROTECTION OF PERSONAL DATA

6.1. OGSTASH processes and shares the personal data obtained during the establishment and execution of this Membership Agreement for the purposes of providing the services specified in the Membership Agreement, the formation of the order for the Product / Service and the realisation of the delivery.

6.2. The Member agrees that he/she can obtain detailed information about the activities of processing and sharing personal data. The Member further agrees that OGSTASH reserves the right to update its agreements and policies at any time in accordance with changes in applicable legislation.

7. COMMERCIAL ELECTRONIC COMMUNICATIONS

7.1. OGSTASH may send commercial electronic messages to the Member for the purpose of promoting and marketing its goods and services through the electronic mail address registered on the Platform or by making a call or sending SMS to the telephone number, if the Member consents to commercial electronic messages.

7.2. The Member has the right not to consent to the sending of commercial electronic messages or to withdraw his/her consent at any time.

8. LISTINGS, PRICES AND ORDERS

8.1. Products are sold as described.Every Product on the Platform is a specific digital item described in its listing. The Buyer receives the Product that is described in the listing at the time of purchase. OGSTASH does not sell randomized, mystery or "chance" items, and the contents of an order are never determined by a draw.

8.2. Listing information. Titles, images, features and descriptions are provided by OGSTASH or by the Seller. Images are illustrative. The listing describes the key contents of the account, such as platform compatibility, included access and notable items, as they exist at the time of delivery.

8.3. Prices and payment. Prices are shown in the currency displayed at checkout and include the items selected by the Buyer, such as optional Warranty Protection. An order is created after the Buyer completes checkout and the payment provider confirms the payment.

8.3a. Coupons and promotional discounts. Coupons, discount codes and other promotional discounts have no cash value, cannot be exchanged for cash or withdrawn, and are not transferable. They apply only to the offers and period stated in the promotion, and OGSTASH may withdraw an expired or misused code at any time.

8.4. Availability. Listings are subject to availability. If a Product turns out to be unavailable after payment, or a listing contains an obvious pricing or description error, OGSTASH may cancel the order and refund the full amount paid, or offer an equivalent replacement that the Buyer may accept or decline.

8.5. Age and consent. The Buyer confirms that they are at least 18 years old, are legally able to enter into a purchase agreement in their country, and accept these Terms by completing the purchase.

9. DELIVERY AND REFUNDS

9.1. Delivery.After payment, the order appears in "My Orders" with the status "Pending" while it is being prepared. Account details are delivered electronically through the Platform, the support chat or the e-mail address provided at checkout. No physical item is shipped.

9.2. Digital content. The Product is digital content supplied immediately after payment. To the extent permitted by applicable law, by completing the purchase the Buyer asks for delivery to begin immediately and acknowledges that the statutory right of withdrawal may be lost once the account details have been delivered.

9.3. Refund or replacement. OGSTASH will refund or replace an order if the payment was taken but the Product was not delivered, if the delivered Product does not match its listing, if the login details do not work at the time of delivery and cannot be fixed, or if the Buyer was charged more than once for the same order. The Buyer should contact support with the order number and the e-mail used at checkout, before changing any account details.

9.4. No refund.A refund is not available for a change of mind after delivery, for loss of access caused by the Buyer's own actions after delivery (such as changing login details, linking or unlinking platforms, or sharing the account), or for action taken by the game publisher after delivery.

9.5. Refund method. Approved refunds are issued to the original payment method. The time it takes for the funds to appear depends on the payment provider.

9.6. This section does not limit any rights that cannot be excluded by law. The full Refund & Delivery Policy applies to every order.

9.7. Orders created by abuse, fraud or payment disputes opened in bad faith may be cancelled, and the related accounts may be suspended.

10. THIRD-PARTY GAMES AND PUBLISHER TERMS

10.1. No affiliation. OGSTASH is an independent store. It is not affiliated with, endorsed by, or sponsored by Epic Games, Inc. or any other game publisher. Fortnite and all other game names, logos and trademarks belong to their respective owners.

10.2. Publisher rules.The sale, transfer or use of a game account may be restricted by the publisher's own terms of service. The Buyer is responsible for checking those terms and for deciding whether to buy and use the account. OGSTASH does not control actions the publisher may take against an account after delivery, and does not guarantee that the publisher will not restrict, suspend or change an account.

10.3. Account contents. Skins, items and other contents of an account are provided as they exist at the time of delivery. Titles, images and descriptions on the Platform are illustrative and are not a guarantee of a specific item, unless the order states otherwise.

11. ACCEPTABLE USE AND PROHIBITED CONDUCT

11.1.The Buyer agrees not to use the Platform for fraud, to pay with a payment method they are not authorized to use, to exploit errors in the Platform, to open payment disputes in bad faith, or to resell access to the Platform's services without permission.

11.2. OGSTASH may verify an order, request additional information, cancel an order, refund the payment, or suspend a user account when it reasonably suspects a violation of these Terms or of applicable law.

12. LIMITATION OF LIABILITY

12.1.To the extent permitted by applicable law, OGSTASH is not liable for indirect or consequential losses, for loss of access caused by the publisher or by the Buyer's own actions after delivery, or for interruptions caused by third-party services such as payment providers or hosting.

12.2.Where liability cannot be excluded, OGSTASH's total liability for an order is limited to the amount the Buyer paid for that order. Nothing in these Terms limits rights that cannot be excluded by law.

13. CHANGES, CONTACT AND RELATED POLICIES

13.1. OGSTASH may update these Terms. The version published on the Platform at the time of purchase applies to that order.
